General Election 2006
PROWL wrote to all candidates in the three constituencies most local to Langness asking the following questions: If
elected to the House of Keys would you press the DoT to accept that:
Malew & Santon Graham Cregeen: "If elected I will assertain the legal advice from the Attorney General with regard to the closure. If it appears from this advice that any department of Government is holding up progress to a satisfactory solution of this matter I will campaign tirelessly for the matter to be resolved." Carol Kermode: "I would have no problem whatsoever in prioritising this matter and find the fact that the AG has found the legal requirements are met is a major plus. I find the lack of action of the DOT as no surprise and will look into the issue." Castletown
Tony Brown: "As you are aware I am supportive of securing a public right of way and as you may recall I questioned the Chief Minister in Tynwald in October about the potential purchase of the necessary land to provide access in case there is a problem in designating a right of way. I was disappointed that DOT has not even initiated any discussions over possible purchase. I would also refer you to my previous correspondence to PRoWL and my meeting with you and your colleagues where I indicated my support. Finally, I can advise you that in my Manifesto (to be issued imminently) I state, "I support the principle of Right to Roam legislation being introduced to provide public access to the countryside, coastlands and shores around the Island. This matter will require full and detailed consultation with the public and landowners." If I am re-elected I intend to pursue consideration of this matter." Rushen
Phil Gawne, DAFF Minister:
"I confirm my strong intention to continue to assist PROWL in its endeavours to ensure continuing public access to all areas of Langness which the Manx public have walked over many decades." John Rimington, DLGE Minister: "The dispute needs to be resolved quickly, in favour of open access." Phil Crellin: "My answers to your 3 questions are yes." Quintin Gill: Though he hasn't replied to this particular letter, Quintin has continually supported PROWL through his questions in Tynwald. Tony Wright: "I'm totally behind PROWL." Juan Watterson: "Alas, I am not a lawyer, and am nowhere near qualified to judge whether the land is deemed a highway or whether they should be deemed a public right of way. [...] If the law shows that the area is indeed a public right of way, I will, of course, fully support your stance in having the obstacles removed along this route." Adrian Tinkler: "Belatedly I would like to confirm for the record that I fully support, based on the information circulated 30th October 2006, that there is prima facie evidence that (a): the routes around and across Langness have become highways in terms of s88 of the Highways Act; (b) the said routes should be designated Public Rights of Way and (c) that on the basis of the above, however without my having fully researching the terms of the relevant legislation and byelaws, that all obstructions should be removed. It will obviously be essential to lobby the respective MHK's for the area and keep the pressure up. I would also be grateful if you would keep me posted on developments. I was defeated last week, but not beaten, and I will be back!" |
