Working to win access around Langness lighthouse for everyone

Extracts from a letter recently sent to PROWL by the Attorney General:

In early February PROWL wrote to the Attorney General. We asked about use of the Highways Act to formally designate the circular route around Langness and Dreswick Point.

In his reply the Attorney General:

  • Shows he believes it is his job to protect Public Rights of Way
  • Invites PROWL to present evidence that people have walked the circular route for more than 21 years - as a right, without express permission, & without obstruction
  • Shows that despite the 1976 agreement to roam and rest between the lighthouse & Langness Point, it may also be appropriate to apply Section 88 to the route between the car park, the lighthouse & Langness Point & declare it a Public Right of Way

Sent by the A.G. on 21st February 2006:

"I have noted your comments in relation to section 88 of the Highways Act 1986. You state that the footpath on the eastern and southern sides of the Langness lighthouse has been enjoyed by the public as a right of way and without interruption for a full period of 21 years prior to the right of the public to use the way being called into question.

"As Attorney General I believe that it is my duty to protect rights of way for the public if there truly is evidence of such rights. The starting point must, however, be the state of affairs which existed on the 8th June 1976 when the then Attorney General announced to the public the grant of permission to enjoy access to Langness Point upon the terms set out in the notice."

... "It will be noted that paragraph 3 of the public notice states that "...members of the public may use the road to the Lighthouse on foot and they will also be granted permission to walk over and rest on Langness between the lighthouse and Langness Point." Do I take it that it is your argument that whereas there may be some doubt about that road being a right of way, members of the public have used another, separate pathway which you describe as "the coastal footpath on the eastern and southern sides of the Langness lighthouse"?

"It would also be helpful to receive any evidence as to whether a notice has been in existence at the car park or any adjoining land stating that the access to Langness lighthouse was by permission only. If such notice was in existence in 1976, has the notice been apparent during the 21 years prior [to the recent change of ownership]?

"I confirm that I will be pleased to discuss these important matters further with you when you have collated your "evidence" in support of the right of way which is claimed."

Action PROWL is taking in response to the Attorney General's letter:

Over the next few weeks PROWL will make contact with a representative sample of supporters who have walked the circular route for more than 21 years and have signalled a willingness to testify to this effect.

We will be asking supporters to sign documents showing they have walked the circular route:
  • for more than 21 years (prior to the recent change of ownership)
  • without obstruction
  • as a right
  • without sight of a notice giving or withholding permission
