Working to win access around Langness lighthouse for everyone

  The Attorney General and PROWL - Part 1

In February 2006 John Corlett, the Attorney General, wrote to PROWL stating that he believed he had a duty to protect Public Rights of Way.

He invited PROWL to submit evidence that people had walked the circular route for more than 21 years - as a right, without express permission, & without obstruction.

He also showed
that despite the 1976 agreement to roam and rest between the lighthouse & Langness Point, it may also be appropriate to apply Section 88 to the route between the car park, the lighthouse & Langness Point & declare it a Public Right of Way.

PROWL takes advice...

Following the A.G.'s letter PROWL members took advice from a previous Attorney General about the form evidence should take.

It was made clear that a single affidavit (signed by an individual and witnessed by a Commissioner for Oaths) should theoretically be sufficient to prompt an investigation into the path's status. It was also suggested that 10 affidavits would be legally impressive.

However, due to the vast groundswell of support for PROWL's efforts to get the circular path re-opened, activists felt duty bound to accept a much larger representative sample from the offended population, who insisted that their individual voices should be heard.

On 2nd June 2006...

PROWL presented the A.G. with:
  • 127 affidavits
  • Additional witness statements and letters of supporting evidence
  • Maps clearly showing the contested footpath
  • Aerial photographs showing the extent the footpaths had been used over time &
  • Historical material showing the path's long-standing cultural importance
At the conclusion of the meeting...
  • The A.G. engaged fully with the documents provided by PROWL and promised to give this important matter his full attention
  • The PROWL delegation felt confident it had provided the evidience necessary to right the wrong imposed on Manx people and visitors through the closure of this traditional highway
Note:
PROWL has concentrated on the circular path because its closure had precipitated the campaign, but has always maintained that the status of the straight route (along the road from the car park to the lighthouse, and out to Langness Point) should also be clarified. The
PROWL delegation was pleased to take up the A.G.'s offer to consider this route too.

What happens next?

Now that PROWL has provided this overwhelming evidence for the A.G. to consider there must be a reasonable period for alternate evidence to be offered.
